KiloPets Terms of Service

Effective date: 2 October 2026

These terms are an agreement between you and Nathan Nitzel, an individual based in Nevada, USA ("we", "us"), who makes and runs KiloPets (the "app" or the "game"). By creating an account or using the app, you agree to these terms and to our Privacy Policy and Consumer Health Data Privacy Policy. If you don't agree, please don't use the app.

1. Who can use KiloPets

• You must be at least 13 years old, or older where the law where you live sets a higher age for agreeing to the use of your personal information yourself. The ages for each country are in section 12 of the Privacy Policy. If you are under that age, you may not create an account.
• Random Encounters is only for players aged 18 or over.
• If you are under 18, or the age of adulthood where you live, please read these terms with a parent or guardian.
• KiloPets is not offered in mainland China.

2. Your account

• You can sign in with email, a one-time email link, Google or Apple. Keep your sign-in details private. You are responsible for what happens on your account.
• Give accurate information, including your date of birth. We use it to keep age-limited features safe.
• One account per person. Don't sell, share or transfer your account.
• You can delete your account at any time in Profile.

3. Health and safety: please read this

KiloPets rewards real exercise. It is a game, not a medical device, and nothing in it is medical advice.

• Talk to a doctor before starting any new exercise, especially if you have a heart condition, are pregnant, have an injury, or take medicine that affects your heart rate.
• Heart Zones reward time spent at 125, 140 and 155 beats per minute and higher. These targets are not right for everyone. Never push yourself to reach a reward. Stop at once if you feel dizzy, faint, short of breath, or have chest pain, and get medical help.
• Heart rate, steps and distance come from your phone, watch or health app and can be wrong. Don't rely on the app for any health decision.
• Be aware of your surroundings when walking or running. Never use the app while driving or cycling in traffic.
• You exercise at your own risk.

4. Virtual items and currencies

• Gold, stepium, heart flow, nibbles, costume tokens, Kubesules, KiloPets and other items in the game are a licence to use them inside the game. They are not your property, have no real-world value, and can't be exchanged for money or sold, traded or transferred outside the game.
• We may change, rebalance or remove items, rewards, prices and rules to keep the game working and fair. We will try to be reasonable about it.
• If your account is closed, its virtual items are gone.

5. Purchases

If the app offers anything for real money, you buy it through the Apple App Store or Google Play, and their terms and refund rules apply. Unless the law where you live says otherwise, purchases are final. Where the law gives you a right to cancel a digital purchase (for example in the EU or UK), you agree that the item is delivered immediately and that you lose that right once it is.

6. Computer-controlled players and AI characters

• Some players, crew members and crews in KiloPets are controlled by the game, not by real people. They help keep ladders, crews and battles active.
• KiloPet chat is written by artificial intelligence (AI), and so are crew chat translations, which are marked "Translated by AI". AI can be wrong, silly or unexpected. Nothing an AI character says is advice.
• Don't share private information (your address, phone number, passwords, financial details) in any chat.

7. Location and Random Encounters

• Local leaderboards use the approximate area you give or allow, such as a postal code or city.
• Random Encounters (18+, opt-in) matches you with other players who were recently in the same wide area, about 5 km. Other players never see your exact location, and encounters happen only inside the game. Never agree to meet anyone from the game in person.

8. Crews, chat and behaviour

You agree not to:

• harass, bully, threaten or abuse anyone;
• post hateful, sexual, violent or illegal content, or anything involving a child;
• share someone else's personal information;
• impersonate anyone, or pretend to be us or a moderator;
• spam, advertise, or post links to scams or harmful sites;
• try to get another player's account or personal details.

We use automatic filters and may remove messages, names or crews, and limit or close accounts, that break these rules. To report a player, a crew message or a KiloPet reply, tap Report next to it in the app, or email [email protected]. A crew message reported by several players is hidden until we review it. You can also block a player: you will no longer see their crew messages or crew invites. They are not told.

9. What you post

Your display name, crew names and descriptions, and chat messages are "your content". You keep ownership of it. You give us a worldwide, free licence to store, show and process it so the game can work (for example, showing your name on a leaderboard or your message in crew chat), for as long as it is in the game. Don't post anything you don't have the right to share.

10. Fair play

Don't cheat. That includes faking steps, heart rate or workouts (for example, shaking your phone or using apps that invent activity), using modified apps, bots or scripts, exploiting bugs, or running more than one account to gain an advantage. If we find cheating, we may remove rewards or rankings and suspend or close accounts. If you find a bug, please tell us at [email protected].

11. Our rights in the game

KiloPets, its characters, art, names, sounds, music and software belong to us or our licensors. We give you a personal, non-transferable licence to use the app for fun, following these terms. Don't copy, sell, reverse-engineer or redistribute the app or its content, except where the law says you may.

12. Changes to the game

The game is always changing. We may add, change or remove features, and we may pause or end the service. If we end the service, we will try to give notice in the app first.

13. Suspension and ending your account

• You can stop using KiloPets and delete your account at any time.
• We may suspend or close your account if you break these terms, if the law requires it, or to protect other players. Where we reasonably can, we will tell you why.

14. Disclaimers

We work hard to keep KiloPets running well, but it is provided "as is" and "as available". We can't promise it will always work, be error-free, or keep your progress forever. Some countries don't allow these disclaimers, so some of this section may not apply to you.

15. Limits on our liability

As far as the law allows, we are not liable for indirect or unexpected losses, or for lost data, progress or virtual items, and our total liability to you is limited to the greater of what you paid us in the 12 months before the claim or USD 50.

Nothing in these terms limits liability that the law says can't be limited, such as for death or personal injury caused by negligence, or fraud. If you live in the EU, the UK or another place with consumer protection laws, you keep all the rights those laws give you.

16. Disputes and governing law

• Please contact us first at [email protected]. Most problems can be sorted out quickly.
• These terms are governed by the laws of the State of Nevada, USA, and disputes go to the state and federal courts in Nevada.
• If you live outside the USA, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts.

17. Changes to these terms

We may update these terms. If a change is important, we will tell you in the app before it takes effect. If you keep using the app after that, you accept the new terms.

18. Translations

These terms are available in English, Japanese, German, French, Simplified Chinese, Korean and Spanish. If the versions differ, the English version applies, **unless the law where you live requires your language's version to apply**.
